West, 76, was arrested in October 2020 on charges of bribery, conspiracy to commit bribery, and unlawful use of a two-way communication device. The charges stem from his alleged attempts to secure a favorable vote from Palm Bay City Councilman Brian Anderson for rezoning his "Plantation Circle" property to allow for commercial development.
The State’s case hinges on the testimony of a confidential source (CS) who claims to have been approached by West, through an intermediary named Puneet Kapur (PK), with offers of increasing sums of money in exchange for Anderson’s vote. Recorded phone calls between PK and West appear to corroborate the CS’s account, capturing West's promise of a "bonus" if PK could secure the councilman’s support.
But West has maintained his innocence from the start, pleading not guilty to all charges. And recent court documents reveal a defense strategy that goes beyond simply denying the bribery attempt. West is painting himself as the target of a political conspiracy, alleging that rivals within Palm Bay’s government are working to sabotage his projects and destroy his reputation.
A December 2023 court filing, listing the witnesses West intends to call in his defense, reads like a who’s who of Palm Bay politics. It includes former mayors William Capote and John Mazziotti, former Deputy Mayor Harry Santiago, current Councilman Kenneth Johnson, and several other individuals with deep ties to the city’s power structure.
The list also includes political consultant Robert Burns, who himself faced charges related to campaign finance violations and the misuse of political action committee (PAC) funds. West has admitted to paying Burns $10,000 for campaign activities but claims to have been dissatisfied with his performance and believes Burns misappropriated the money.
West’s defense team is also aggressively seeking phone records from various sources, including Verizon, AT&T, FDLE, the City of Palm Bay, and the Brevard County Sheriff’s Office. These records, they argue, will support West’s alibi, establish communication patterns that contradict the prosecution’s narrative, and potentially expose flaws in the investigation.
A motion filed in March 2024 seeks to compel the State to provide any evidence that might be favorable to West’s defense, focusing on the CS’s credibility and any potential biases or inconsistencies in their testimony.
The case has been ongoing for nearly four years, with multiple delays and continuances. A motion to reduce West’s bond, filed in September 2023, reveals he’s been battling prostate cancer and highlights his lack of prior criminal history.
As the case heads towards a potential trial, the intrigue surrounding West’s alleged bribery scheme continues to deepen. Palme dias has had corruption for as long as I can remember. The council that includes Capote, Santiago, Johnson, Holton, Bailey and Anderson had really cross the line when the FLE found out about their “Clubhouse” which included sex parties, drugs, and alcohol, prostitution, and back door deals against the sunshine laws. As well as David Isnardi former city manager and his friend Jose Aguilar attempted to plant drugs in Bailey’s car all in attempt to get the council members to vote in favor of their agendas. It is time for all of this to come to public light so all the residents of Palm Bay, including the newest residents to discover the truth about Palm Bay council members a few years ago. Sadly, I don’t believe the corruption is gone since they have been voted out. We need to have criminal background checks and drug testing.
