If you read Title 8 U.S.C. § 1324b it does not say that you can't discriminate against non-citizens. Look at the Exceptions section. Non-citizens who do not apply for citizenship when (or shortly after) they are first eligible to apply for citizenship, may be discriminated against.

In reality unless a non-citizen held a similar job in the old country they are unlikely to be the most qualified person for these jobs in this country.

Since governments work for the citizens, citizens should be giving hiring preferences. Title 8 U.S.C. § 1324b does not mention its intent to include or exclude government jobs. Congress should fix this.

Good point on the point of elected official not using public monies to influence referendums but the governor already let that horse out of the barn so to speak
